Terms & Conditions

1. Definitions

"WebMall", "we", "us", "our" refers to WebMall Kenya. "User", "you" refers to any visitor, buyer, seller, or affiliate on our platform.

2. Account Responsibilities

You must provide accurate, complete registration details. You are solely responsible for maintaining the confidentiality of your credentials and all activities occurring under your account.

3. Buyer Obligations

Buyers agree to pay for ordered items and verify deliveries in a timely manner. Placing fake orders or refusing legitimate delivery attempts violates platform rules.

4. Seller Obligations

Sellers must list authentic items, specify correct pricing/stock, fulfill orders on time, and pay standard marketplace commissions.

5. Payments

We support M-Pesa, card payments, bank transfers, and wallets. Payments are held in escrow until order delivery is validated.

6. Refunds

Refunds are processed back to the original source (M-Pesa or wallet) upon confirmation of order cancellation or approved returns.

7. Returns

Eligible items can be returned within 7 days. Returned products must be in their original packaging, unused, and with tags attached.

8. Delivery

Deliveries are handled by verified riders. Risk of loss passes to the buyer once the package is delivered and marked completed.

9. Marketplace Rules

Users must not engage in price-fixing, shell purchasing, posting prohibited items, or harassing other members.

10. Digital Products

Digital downloads and gift cards are final sale and non-refundable once the access key or code is generated or delivered.

11. Intellectual Property

All content, trademarks, logo designs, and system code are the intellectual property of WebMall. Sellers retain rights to their product media but grant WebMall a license to display it.

12. Fraud Prevention

We utilize automated fraud detection checks. Any user found using stolen cards, duplicate transaction codes, or fake M-Pesa statements will be permanently banned.

13. Account Suspension

We reserve the right to suspend or terminate accounts that breach these terms, have high return rates, or low seller ratings.

14. Dispute Resolution

Disputes between buyers and sellers will be arbitrated by WebMall Support. Legal actions must be filed in Nairobi, Kenya.

15. Privacy

Our data collection and usage policy is governed by our Privacy Policy, aligned with the Kenya Data Protection Act.

16. Limitation of Liability

WebMall is not liable for indirect, incidental, or consequential damages arising from the use of our marketplace services.

17. Applicable Law

These Terms & Conditions are governed by and construed in accordance with the laws of the Republic of Kenya.

18. Termination

Either party may terminate this agreement at any time by closing their account, subject to resolving any pending orders or wallet balances.

19. Amendments

We may modify these terms at any time. Continued use of the platform constitutes acceptance of the amended terms.

20. Force Majeure

WebMall is not responsible for failures due to acts of God, civil unrest, government regulations, or telecom outages.

21. Entire Agreement

These terms constitute the entire agreement between you and WebMall regarding the use of the platform.
